The muddied / muddled waters of cost division in cleanups for Superfund and similar sites, thanks to Burlington, are the subject of a short webinar from Sharon Newlon and John Tatum. Sharon will review the current state of the law and John will discuss some strategies for reviewing the factual material at sites to support a settlement. Untangled mixed waste streams, physical separation, time distinctions are possible differentiators. An additional discussion topic will be the costs of failure to reach a settlement and some of the benefits, beyond cost avoidance, of reaching an agreement.
